1. Overview

This website is operated by HZANG TRADING LLC, trading as Rootelier. Throughout the site, the terms "we", "us" and "our" refer to Rootelier. By visiting rootelier.com or purchasing from us, you agree to be bound by these Terms of Service, including the additional terms and policies referenced here and available by hyperlink, in particular our Shipping Policy, Refund Policy, Privacy Policy, Warranty.

If you do not agree to all of these terms, please do not use this site or place an order.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. By ordering, you represent that you meet those requirements and that the information you provide is accurate and complete.

3. The store and your account

You may browse without an account. If you create one, you are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorized use.

4. Products, descriptions and images

We sell solid-wood furniture. Wood is a natural material: grain, color, figure, knots and mineral streaks vary from board to board, and no two pieces are identical. Photographs on this site show representative examples. Variation in grain and color between the photograph and the piece you receive is a characteristic of the material, not a defect, and is not grounds for a return under the damaged-or-defective route.

Dimensions are given in inches and are accurate to within a normal woodworking tolerance of ±0.25″ unless stated otherwise. Solid wood expands and contracts with humidity; small seasonal movement and hairline gaps at joints are normal.

Colors displayed depend on your screen. We recommend requesting a finish sample before ordering a large custom piece if exact color matters to you.

We may change or discontinue any product at any time without notice, and we reserve the right to limit quantities or refuse any order.

5. Pricing and errors

All prices are in US dollars and exclude sales tax, which is calculated at checkout. Prices may change at any time before you place an order; the price at the moment your order is accepted is the price that applies.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If we discover an error in an order you have placed, we will contact you, give you the option to confirm at the corrected price or cancel, and refund you in full if you cancel. We do not have to sell at an obviously erroneous price.

6. Orders and acceptance

Placing an order is an offer to buy. Your order is accepted when we send an order confirmation or, if earlier, when we ship. We may refuse or cancel an order for reasons including product unavailability, an error in the listing, a suspected fraudulent or reseller order, or an order we cannot lawfully fulfil. If we cancel, we refund you in full.

7. Made-to-order and custom work

Most of our pieces are built after you order. When you order a made-to-order or custom piece:

• the specification we confirm in writing (dimensions, wood species, finish, hardware)is the specification your piece is built to;
• changes requested after production has started may not be possible, and may be chargeable;
• the piece is final sale for change-of-mind purposes, as set out in the Refund Policy;
• the handling times published on the product page apply, and are estimates made in good faith.

8. Bundles

A bundle is a group of products sold together at a discount as a single purchasable item. Bundle pricing applies only while all components are purchased together. Bundles ship together, and the longest component handling time applies to the whole bundle. Bundle returns are governed by the Refund Policy.

9. Payment

We accept the payment methods listed on our payment methods page. By submitting payment information you represent that you are authorized to use the payment method. Pay-over-time financing, where offered, is provided by a third party under its own terms and is subject to its approval, not ours.

10. Shipping, risk and title

Shipping is governed by the Shipping Policy. Risk of loss passes to you on delivery to the address you supplied. Title passes when we have received payment in full.

11. Returns and warranty

Returns are governed by the Refund Policy. Product defects are additionally covered by the 1-Year Limited Warranty.

12. Acceptable use

You agree not to use the site for any unlawful purpose; not to attempt to gain unauthorized access to it; not to scrape, spider or harvest data from it; not to upload malicious code; not to interfere with its security features; and not to submit false, defamatory or infringing content in reviews or forms. We may terminate your access for breach of this section.

13. Intellectual property

All content on this site (text, photographs, video, designs, logos, and the arrangement of them) is owned by Rootelier or its licensors and is protected by US and international intellectual property law. You may not reproduce, distribute or create derivative works from it without our written permission, other than normal personal browsing and printing.

If you submit a review, photograph or comment, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display it in connection with the Services and our marketing, and you confirm you have the right to grant that license.

14. Disclaimer of warranties

Except for the express 1-Year Limited Warranty and any rights you have under applicable law that cannot be excluded, the site and the products are provided "as is" and "as available". We do not warrant that the site will be uninterrupted, timely, secure or error-free. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Rootelier, its owners, employees and suppliers will not be liable for indirect, incidental, punitive or consequential damages, including lost profits or loss of data, arising from your use of the site or the products. Our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud, where such limitation is not permitted by law.

16. Indemnity

You agree to indemnify and hold harmless Rootelier and its affiliates from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

17. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in New Mexico for any dispute arising out of these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, that provision is severed and the rest remain in force. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Services, and supersede any prior agreements.

19. Changes

We may update these Terms at any time by posting the revised version on this page. Continued use of the site after a change means you accept the revised Terms. The version in force when you place an order is the version that governs that order.
